While it appears that the debate on the legality of CBD from Industrial Hemp is settled, Congress did provide the states with the authority to impose stricter regulations on Hemp production and therefore CBD beyond those prescribed in the 2018 act. Consequently, the legality of Hemp derived CBD is still subject to a state by state analysis. It is up to each customer to find out on their state level, whether CBD Oil is legal in their state.
